OPERATING TERMS AND CONDITIONS

 

1. CONTRACT

The terms and conditions set out below relate to work carried out by Handley Electrical Maintenance Limited and they constitute part of any order that has been received and the work completed by Handley Electrical Maintenance Limited.

(i) These terms and conditions will apply to any work completed by Handley Electrical Maintenance Limited for verbal and written orders regardless of the work completed.

(ii) Handley Electrical Maintenance Limited will remain the owners of any materials or equipment used on any work completed until the materials or equipment is paid for in full.

(iii) The customer will be responsible for all materials and equipment used on any work completed once it has been delivered or installed on site.

(iv) Handley Electrical Maintenance Limited reserve the right to remove any equipment or materials used on any work completed if the equipment, materials or labour costs have not been paid for in full by the date stated on the invoice.

(v) All work completed by Handley Electrical Maintenance Limited and all labour, materials and equipment costs due will be paid for within thirty days of the date stated on the invoice.

(vi) Any deviation in the payment terms for all materials, equipment and labour costs will be by prior written arrangement with Handley Electrical Maintenance Limited and the customer.

(vii) Failure to comply with the payment terms and conditions set out by Handley Electrical Maintenance Limited will result in the customer being charged interest rate at 3% above the bank lending rate at the date of the invoice.

(viii) All payments, unless agreed prior to works, are subject to VAT at the standard rate.

 

2. LABOUR

(i) The ‘time start’ is the time the engineer started for customers’ site from Handley Electrical Maintenance Limited’s office. In some cases this may be another site or starting point of the engineer.

(ii) The ‘time arrived’ is the time the engineer arrived on the customers site.

(iii) The ‘time leave’ is the time that the engineer leaves site. This may be immediately following the signing of this document or a time later depending upon circumstances.

The signee should clarify with the engineer if the time indicated is acceptable, any comments made to be recorded on the job sheet.

(iv) The ‘finish time’ is the time that the engineer returns to Handley Electrical Maintenance Limited’s office. In some cases this may be another site or the starting point of the engineer.

(v) Works are arranged by prior appointment. Any instances of our engineer being able to gain ready access to carry out the required works not of our making will be chargeable.

(vi) The invoice will be for the total time including travel at the rate agreed. The rate for travel will be the same as the onsite labour rate unless agreed between both parties prior to works commencement.

 

3. MATERIALS

(i) The materials listed are as used by the engineer. On jobs carried out over a number of visits the materials may be booked on one sheet only.

(ii) In other cases materials may be added by the office at a later stage. This may be as a result of materials being supplied direct to site and the paperwork not being available to the engineer.

(iii) Any omission of materials on the job sheet does not mean they will not be charged.

(iv) Repairs will be listed and may not be covered by a warranty.

 

4. TRAVEL

(i) The mileage listed will be charged at the rate current at the time of the works completed. The current rate being charged can be requested by telephoning the office during normal office hours or emailing the address listed at the top of the job sheet.

(ii) The mileage accrued will be from the office address to site and return to the office at the end of day/job. It may also include any additional miles travelled to local suppliers, etc for materials needed for the job.

(iii) If the job is at the request of the customer i.e. for contracts of less than one day, typically, for call-outs and one –off jobs, travel may be from another site which may increase or decrease the travel cost, any additional cost may be borne by the customer.

 

5. ORDER NUMBERS

(i) There is a space for the customer to fill in a purchase order number to assist Handley Electrical Maintenance Limited through invoicing and/or the customer system. The exclusion of this number or a number that is incorrect will not affect the validity of this document. The information supplied by our engineer and the customer’s signature is the binding contract between Handley Electrical Maintenance Limited and the customer.

 

6. WARRANTY

(i) Handley Electrical Maintenance Limited will provide a warranty on parts and labour for 12 months following the date of installation.

(ii) The warranty on parts is provided by each manufacturer. Their warranty is dependant on their conditions and can be supplied on request. In cases where manufacturers warranty exceeds our 12 month warranty there will be a charge on labour and associated costs.

(iii) Handley Electrical Maintenance Limited are not responsible for any consequential loss due to product failure or delays in rectifying any warranty condition.

(iv) In cases where replacement of faulty parts involves additional equipment to complete the work the customer will be expected to supply or pay for this equipment or any associated costs. The warranty only covers labour and defective material to be replaced under warranty.

(v) Any warranty is void if:-

a) The customer carries out any unauthorised work on a Handley Electrical Maintenance Limited installation/equipment.

b) The customer fails to take care of the installation/equipment in accordance with Handley Electrical Maintenance Limited requirements provided on request.

c) If the purpose of the installation or the function of the installation alters from original design.

d) If second-hand or re-conditioned equipment is used. In some cases a limited warranty will apply to re-conditioned equipment by written notification and a 3 month maximum duration.

 

7. HEALTH & SAFETY

(i) We reserve the right to withdraw our services if we feel that the provision for Health & Safety for our engineers, your personnel and the public alike are at risk.

(ii) We reserve the right to re-visit any electrical installation for twelve months without hindrance for monitoring and/or inspection by ourselves or an independent engineer.

 

8. WASTE

(i) All waste will be placed in bins/skips provided by the customer at the place of works completed.

(ii) Waste will be separated to suit the customers’ requirements. We do not remove waste unless agreed in writing by Handley Electrical Maintenance Limited prior to works commencement.

(iii) Hazardous waste will be assessed individually and the customer advised on how to safely dispose of such waste.

(iv) If waste and hazardous waste is required to be removed from site an additional charge will be applied.
